These Terms of Service (“Terms”) govern your access to and use of the Empire Auto Protect mobile application (the “App”) and the website at empireautoprotect.com (collectively, the “Services”) operated by Empire Auto Protect, LLC (“Empire,” “we,” “us,” or “our”). By creating an account or otherwise using the Services, you agree to these Terms.

1. The Services

The Services allow Empire customers to view information about their vehicle service contracts, home warranties, or other coverage products administered or brokered by Empire, including:

• Viewing policy details, contract documents, and identification card.
• Initiating contact with the applicable administrator to file a claim or request roadside assistance.
• Linking to your finance company’s payment portal.
• Receiving notifications about your policy or payments.

The Services are a customer-facing interface only. Empire does NOT itself underwrite, administer, or insure any product through the App. All coverage, claims handling, and payment processing are performed by the corresponding administrator or finance company.

2. Eligibility

You must be at least 18 years old and a U.S. resident to create an account. You must already be a customer of Empire (or a customer of a policy Empire brokered) with an active or recent policy in our records. We verify your status during signup using your policy number plus a second factor (last 8 of VIN for auto/RV policies, or property ZIP for home policies) AND your phone number on file.

3. Your Account

• You are responsible for keeping your password confidential and for all activity that occurs under your account.
• You agree to provide accurate information at signup and to keep your account current.
• You may link multiple policies to one app login, provided each is verified and belongs to the same customer record.
• You may delete your app login at any time through Profile → Delete App Login. This removes your sign-in only; it does not cancel or modify your underlying policy.

4. License

Subject to your compliance with these Terms, Empire grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App except as permitted by these Terms.
• Reverse engineer, decompile, or attempt to extract source code.
• Use the Services to harass other users, transmit spam, or violate any law.
• Probe, scan, or attempt to compromise the security of the Services.
• Use automated tools (bots, scrapers) to access the Services without our written permission.

5. Third-Party Services

The Services link to or rely on third parties including (but not limited to) InlineCRM, MEPCO, SPARTA, EFS / Ensurety, WALCO, Aegis, Maverick Payments, and RepairPal. Your use of those third-party services is subject to their own terms and privacy policies. We are not responsible for the content, accuracy, or availability of third-party services.

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WHILE WE WORK HARD TO KEEP POLICY DATA ACCURATE, DATA SHOWN IN THE APP ORIGINATES FROM THIRD-PARTY ADMINISTRATORS AND IS FOR REFERENCE ONLY. YOUR ACTUAL CONTRACT, COVERAGE LIMITS, AND CLAIM RIGHTS ARE GOVERNED BY YOUR ORIGINAL POLICY DOCUMENTS — NOT BY ANY INFORMATION DISPLAYED IN THE APP. IF THERE IS A DISCREPANCY, THE POLICY DOCUMENTS CONTROL.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMPIRE AUTO PROTECT, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY IN ANY MATTER ARISING FROM THESE TERMS WILL NOT EXCEED $100.

8. Indemnification

You agree to indemnify and hold harmless Empire and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable attorney’s fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason in our reasonable discretion. You may stop using the Services and delete your app login at any time.

10. Governing Law

These Terms are governed by the laws of the State in which Empire Auto Protect, LLC is registered, without regard to its conflict of law principles. You agree that any dispute will be resolved in the state or federal courts located in that state.

11. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above will reflect the most recent revision. Continued use of the Services after a change indicates acceptance.
